A. Session Fees

Client agrees to pay photographer a retainer at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward securing the date of the session. The balance is due when the online gallery is delivered. Images may not be used until payment in full is received. The session fee covers the planning of the photo session, the photo shoot on location, an online gallery of all images that turned out well (as determined by photographer), light post-production editing and image storage for 30 days.  Additional editing is available at additional expense if requested by Client. 

C. Rescheduling

If an illness or other urgent situation prevents a session from taking place, Client may reschedule their session at least 24 hours prior to their shoot without any fees. Should Client fail to give 24 hours notice, or decide to cancel the shoot, the session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.

Photographer is not responsible for any injuries inflicted upon any participating parties. Client will be responsible for their children and for themselves and release photographer from any claims against their person or their business. 

.While every reasonable effort will be made to produce and deliver outstanding photographs during the session, the entire liability of the Photographer to the Client for any claim or loss arising from our performance is limited to a refund to the Client of the amount paid for services.

While Photographer will make every reasonable effort to take photos specifically requested by the Client, the Client understands that this is an uncontrolled event and that due to the vagaries of the weather, available light, time restrictions, and willingness of subjects, Photographer cannot guarantee that ALL requested photos will be taken.

E. Re-shoots / Refunds

Re-shoots are determined at the discretion of Photographer. Re-shoots and refunds will not be given if Client is unhappy with their choices of clothing and make-up or for undesired weather.

FILE STORAGE

After twelve (12) months, all media may be deleted from photographer’s online storage, except as needed for promotional purposes, to be determined by Photographer at Photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond Photographer’s control.

All photographs created by Photographer are copyright protected. It is a violation of federal copyright law to copy, scan, or allow photographs Photographer has created to be screen-shot-ed, reprinted, duplicated, digitally reproduced, copied, scanned, or altered (digitally or otherwise), without Photographer’s express written permission:

Photographer hereby grants to the Client a non-exclusive limited use license to download and copy the online images in the final downloadable media under the terms specified in this agreement.  The following restrictions apply:

The images may not be resold, re-licensed, or sub-licensed.

Title and ownership, and all rights now and in the future, of and for the media remain exclusively with the photographer.

There are no warranties, express or implied. The media is provided 'as is.

Photographer will not be liable for any third-party claims or incidental, consequential or other damages arising out of this license or buyer's use of the media

With signing this document Client releases and discharges Photographer from all and any claims and demands ensuing from or in connection with the use of the media, including any and all claims for libel and invasion of privacy
