Client Agreement
A. Session Fees
By countersigning this document, Client places a firm work order. Client agrees to pay photographer a retainer at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward securing the date of the session. The balance is due when the online gallery is delivered. The session fee covers the planning of the photo session, the photo shoot on location, an online gallery of proof images to choose from, the agreed upon number of final high resulution digital files and image storage for 30 days.
B. Location Costs & Fees
If there are any costs/fees associated with the location Client has chosen for their session, Client will be responsible for those fees. The client will make sure to have the agreed upon location available and looking as discussed previously. The session fee covers travel on Bainbridge Island, North Kitsap and within downtown Seattle. Any location outside of these limits will be subject to an additional travel fee.
C. Scheduling
Client will ensure that the staff have consented to their images being taken and used commercially. Client will ensure team members will be available on time to have their photo taken and look the way the Client desires. If a special clothing type was agreed on, Client will make sure that staff complies.
If an illness or other urgent situation prevents a session from taking place, Client may reschedule their session at least 24 hours prior to their shoot without any fees. Should Client fail to give 24 hours notice, or decide to cancel the shoot, the retainer fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
D. Re-shoots
In case some members of the team are not available at the time of the photoshoot, there will be an option for an additional session date for an additional fee. This includes re-shoots if Client is unhappy with their choices of clothing, make-up, hair style.
E. Media
Proof Images will be delivered 3 weeks after the date of the session. Final images will be ready for download 3 weeks after favorites for all team members are choosen.
All images will be delivered via a digital online gallery. Final media available for download may only be accessible within 30 days of the upload. If this is a concern or there are technical issues, please contact Photographer immediately so these can be resolved and Client can store the images according to their needs.
After twelve (12) months, all media may be deleted from photographer’s online storage, except as needed for promotional purposes, to be determined by Photographer at Photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond Photographer’s control.

Photographer is not responsible for any injuries inflicted upon any participating parties. Client will be responsible for their staff and for themselves and release photographer from any claims against their person or their business.
While every reasonable effort will be made to produce and deliver outstanding photographs during the session, the entire liability of the Photographer to the Client for any claim or loss arising from our performance is limited to a refund to the Client of the amount paid for services.
While Photographer will make every reasonable effort to take photos specifically requested by the Client, the Client understands that this is an uncontrolled event and that due to the vagaries of the weather, available light, time restrictions, and willingness of subjects, Photographer cannot guarantee that ALL requested photos will be taken.
H. Use License
All photographs created by Photographer are copyright protected. It is a violation of federal copyright law to copy, scan, or allow photographs Photographer has created to be reprinted, duplicated, digitally reproduced, copied, scanned, or altered (digitally or otherwise), without Photographer’s express written permission.
Photographer hereby grants to the Client the right to download and use the online images in the final downloadable media under the terms specified in the Client Agreement, if signed. The following restrictions apply:
The images may not be resold, re-licensed, or sub-licensed.
There are no warranties, express or implied. The media is provided 'as is.'
Photographer will not be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer's use of the media
With signing this document Client releases and discharges Photographer from all and any claims and demands ensuing from or in connection with the use of the media, including any and all claims for libel and invasion of privacy.
I. Proof gallery
After photo shoot, images will be reviewed for quality by Photographer and placed into a proof gallery for Client to select the final images purchased. This proof gallery is typically available 21 days after the photo shoot. Images for the proof gallery are hand-selected based on the photos that best represent the Client, the atmosphere, and the quality of work the Photographer provides.
These image proofs cannot be used by Client in any way other than to select the final images.
If Client would like to receive all proofs from a session, they can be purchased separately. Signature below indicates understanding of this.(required)
By signing below, Client agrees to the Client Agreement and state that they have read and fully understood these terms and conditions.
